Jaix Pty Ltd (ABN 89 079 802 181, ACN 079 802 181) of Level 1 North, 13 Greenhill Road, Wayville SA 5034 ("Jaix", "we", "us", "our") is committed to protecting your privacy. This policy explains how we collect, use, disclose and safeguard personal information, and how you can access or correct it.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). We review this policy against new technology, business practice and our customers' needs.

What this policy covers

This policy covers two things:

  1. This website (jaix.com.au) and our sales, marketing and support activities.
  2. Our software, including the JAIX freight platform and the JAIX Driver and JAIX MetroLink mobile apps.

Our software is used by our customers (transport and logistics carriers) to run their operations. Where we handle personal information inside a customer's system on their behalf, that customer decides how the information is used, and their own privacy policy applies to it. Our role and responsibilities for the mobile apps are set out in the "Mobile apps, location and camera" section below.

The information we collect

Information you give us. When you contact us, request a demo, subscribe to updates or deal with us as a customer or supplier, you may give us your name, business name and role, email address, postal address, and telephone number, along with the content of your enquiry. If you correspond with us by email, we may keep those messages, your address and our replies, with the same care we apply to mail and phone contact.

Information we collect automatically. Like most websites, we use cookies and web server logs to understand how the site is used. This may include your IP address, device and browser type, the pages you view, the date and time of your visit, how long you stay, and the site you came from. See "Cookies and analytics" below.

Payment information. If you make a payment to us, it is processed through a third-party payment provider. We do not store your full card details.

We do not collect sensitive information (such as health information) through this website. If we ever need to, we will ask for your consent first, unless the law allows otherwise.

Cookies and analytics

A cookie is a small text file a website stores on your device. Cookies let us tell you apart from other visitors, keep you signed in where needed, and measure how the site is used so we can improve it. Cookies do not let us collect personal information from your device or pass on viruses.

We use:

  • Google Analytics to measure site traffic and usage. Google may process this data outside Australia. You can opt out using Google's browser add-on.
  • HubSpot, which provides our website, forms, email and customer records, and sets cookies to support those functions.
  • A preference cookie that remembers when you have dismissed a site notification, so we do not show it again.

Most browsers accept cookies by default. You can set your browser to refuse them, though some parts of the site may not work as well if you do.

How we use your information

We use personal information to:

  • respond to your enquiries and provide the products and services you ask for;
  • administer our business, including billing and account management;
  • operate, monitor and improve this website and our services;
  • carry out our marketing, with your consent or where the law allows, and measure how it performs;
  • tell you about changes to the site, new services and offers we think you will value; and
  • meet our legal obligations.

We only use your information for the purpose we collected it, for a related purpose you would reasonably expect, or where you have consented or the law requires it.

Direct marketing

We may send you marketing about our products and services where you have opted in or where the law allows. Every marketing email includes an unsubscribe link, and you can opt out at any time by using it or by emailing us at sales@jaix.com.au. We will action your request as soon as we can. We handle electronic marketing in line with the Spam Act 2003 (Cth).

When we disclose your information

We do not sell, rent or lease information that identifies you. We may disclose personal information to:

  • service providers who help us run our business and this website (for example our website, CRM, email, hosting and analytics providers), bound to protect it and use it only for the services they provide to us;
  • a third party where you have asked us to, or consented; and
  • a person or body where we are required or authorised by law, or where we reasonably believe disclosure is necessary to protect our legal rights, enforce our terms, or protect the safety of our users or the public.

Overseas disclosure

Some of our service providers are located, or store or access data, outside Australia. In particular:

  • HubSpot (United States). Data for our region is hosted in Australia, but HubSpot personnel may access it from the United States and other countries where HubSpot operates.
  • Google (United States) for analytics.

Before disclosing personal information overseas we take reasonable steps to ensure it is handled consistently with the APPs. Our software's operational data for our customers is held on our servers in Australia, at our nodes in Adelaide (SA), Sydney (NSW) and Melbourne (Vic).

Storing and securing your information

We hold appropriate physical, electronic and managerial measures to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. No system is completely secure, so we cannot guarantee absolute security, but we work to protect your information and to keep it accurate and up to date.

We keep personal information only for as long as we need it for the purposes described in this policy, or as the law requires, after which we destroy or de-identify it. [Confirm retention periods for website enquiries, marketing subscribers and CRM records.]

Data breaches

We comply with the Notifiable Data Breaches scheme. If we have reasonable grounds to believe an eligible data breach has occurred that is likely to cause serious harm, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.

Accessing and correcting your information

You can ask for access to the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Email sales@jaix.com.au. We may need to verify your identity first. We will respond within a reasonable time, usually within 30 days. Access is generally free, though we may charge a reasonable cost for retrieving and supplying extensive records. If we refuse access or a correction, we will explain why and how you can respond.

Mobile apps, location and camera

This section applies to the JAIX Driver and JAIX MetroLink apps on Android and iOS. These apps are used by the employee or subcontractor drivers of our customers (carriers) to manage freight transport.

For these apps, the carrier you log in to controls your data and decides how it is used, and their privacy policy applies. Jaix operates the apps on the carrier's behalf.

Location data. While you are logged in to your carrier, the app collects your GPS location, both while you are using the app and while it runs in the background. Your location is used by that carrier to:

  • show your current location on their maps;
  • view and track routes and locations over time;
  • reverse geo-code locations when you arrive at and complete work;
  • provide turn-by-turn navigation and route optimisation; and
  • provide geofence and navigation alerts and monitoring.

Location data is only available within the carrier's system you are logged in to. Retention is set by that carrier. Jaix does not share this data with any other party.

Camera. If you choose to take photos while doing work in the app, the app will ask to use your camera. Photos you attach to your work are sent to your carrier's system and stored against the relevant work records.

Your choices. You can stop location collection by logging out of the app, and you can manage app permissions (location, background location, camera) in your device settings. Some app functions may not work if permissions are switched off.

Other websites

Our site may link to other websites. We are not responsible for the privacy practices or content of those sites. When you follow a link away from our site, this policy no longer applies, and you should read the privacy policy of the site you go to.

Children

Our website and services are intended for businesses and are not directed at children. We do not knowingly collect personal information from children.

Changes to this policy

We may update this policy from time to time. The current version is always posted on this page with the "last updated" date above. Please check back periodically. We will not use personal information you have already given us in a way that is materially inconsistent with the policy under which it was collected, without your consent.
